About the Independent Contractor Agreement for law firm engaging lawyer template

 The Independent Contractor Agreement for law firm engaging lawyer template is a template independent contractor’s agreement for a Principal of a law firm (Business) engaging an independent contractor for work in the Business.

  • This Template is a general template drafted for Australian laws.

  • Note that an independent contractor’s agreement does NOT create the same employment relationship between the parties as an employment agreement. As a result, a contractor remains responsible for insurance, tax and other leave entitlements and can only collect the agreed Price under the contractor’s agreement.

  • Before using this template, we suggest you review the Australian Tax Office (ATO) guidelines

What this template includes:

  1.  A detailed schedule setting out the services, exclusions and practising certificate and insurance details

  2. A price clause and agreement that complies with the Superannuation Guarantee Legislation (ie if superannuation is payable for the contractor as it is in cases where the services are personal services, there is a clause to ensure the price includes this as an inclusive amount);

  3. Optional restraint clauses;

  4. Obligations of the each party;

  5. Use of legal practice management software including access to it and confidentiality etc

  6. Conflicts of interest where the Contractor also takes work direct or from other law firms;

  7. and much more.
